Job description: THE ROLE

The General Counsel will ensure the delivery of the legal services across the Social Services Regulator’s regulatory and operational matters under the Social Services Regulation Act 2021 (Vic) and other relevant legislation. This includes leading the establishment of the Social Service Regulator’s legal functions covering a broad range of legal, regulatory, administrative and legislative matters, and providing expert and timely advice on highly complex and sensitive legal matters.

Initially, this position will nominally report to the Executive Director, Regulation and Reform within the System Reform and Workforce Branch of DFFH, and in effect report to the Social Service Regulator in their transition capacity until the Social Service Regulator is established on 1 July 2024. The role will then be transitioned to the Social Service Regulator in line with the Public Administration Act 2004 (Vic).

ACCOUNTABILITIES INCLUDE

  • Provide leadership and guidance to establish the Regulator’s legal function and team, ensuring expert legal advice and support is provided to deliver the statutory remit and build confidence in the Social Service Regulation Scheme.
  • Provide strategic, risk-based legal advice and counsel on social service regulation and laws, and legal issues related to the Regulator’s functions, including including complaints, notifications, investigations and a broad range of administrative law, legsislative interpretation and corporate governance relating to the operation of the Regulator and other related matters, ensuing that timely authorative advice is provided as required.
  • Provide expert legal advice on policy and commercial matters relating to designated contracts including review, preparation or outsourcing of commercial and contractual terms and conditions for contracts, subcontracts and other instruments.
